Terms of Use

This document is a working draft generated for the Wishmori product and reflects its implemented behavior as of the date above. It is not legal advice. Have it reviewed by a qualified legal professional, and replace the bracketed placeholders below, before relying on it in production.

These Terms of Use ("Terms") govern your access to and use of Wishmori, a product of Fendaro ("we", "us"). By creating an account or using Wishmori, you agree to these Terms.

1. Acceptable use

You may use Wishmori to create personalized birthday experiences and birthday emails for recipients you have a genuine relationship with. You agree not to use Wishmori to send unsolicited bulk email, to harass or impersonate any person, or to distribute content that is unlawful, defamatory, or infringing.

2. Account responsibilities

Wishmori accounts are created via Google sign-in. You are responsible for the security of the Google account you use to sign in and for all activity under your Wishmori account. Notify us immediately at support@fendaro.online if you suspect unauthorized access.

Each account may have up to four active birthday experiences at a time, and each birthday experience is automatically deleted, along with its photos and email drafts, one week after it is created. We may change these limits at any time.

3. Your content

You retain ownership of the names, messages, photographs, and other content you upload to Wishmori ("Your Content"). You grant us a limited license to store, process, and display Your Content solely to operate the birthday experience and email features you configure.

You represent that you have the necessary rights and permission to upload and share any photograph, message, or personal detail you submit, including permission from any person whose name, likeness, or personal information appears in Your Content.

4. Prohibited content

You may not upload or generate content that is illegal, harassing, hateful, sexually explicit involving minors, or that violates the rights of others, including privacy and intellectual property rights.

5. Email sending responsibilities

Wishmori's birthday email feature is for sending personal birthday greetings to recipients you know, with an experience you created for them in mind. You are responsible for the accuracy of any recipient email address you provide and for reviewing and approving AI-generated content before it is sent. You agree not to use the email feature for marketing, solicitation, or bulk messaging unrelated to a personal birthday greeting.

6. AI-generated content and your API key

Generating a birthday email requires connecting your own Google Gemini API key under Settings. You are responsible for that key, for any usage or cost associated with it under your own Google account, and for complying with Google's applicable terms for the Gemini API. Email content drafted by Gemini is a starting point based on information you supply. You are responsible for reviewing generated content for accuracy and appropriateness before approving it for delivery. We do not guarantee that AI-generated content will be free of errors.

7. Intellectual property

The Wishmori name, logo, themes, and underlying software are owned by Fendaro and its licensors. Nothing in these Terms grants you rights to our brand or software except the limited right to use the Service as intended.

8. Third-party integrations

Wishmori relies on third-party services, including Google's Gemini API and Resend, to provide certain features. Your use of features powered by these services is also subject to those providers' own terms, to the extent applicable.

9. Service availability

We aim to keep Wishmori available and reliable but do not guarantee uninterrupted access. We may modify, suspend, or discontinue any part of the Service at any time.

10. Suspension or termination

We may suspend or terminate your access to Wishmori if you violate these Terms, including for prohibited content or misuse of the email sending feature.

11. Limitation of liability

To the fullest extent permitted by law, Fendaro is not liable for indirect, incidental, or consequential damages arising from your use of Wishmori. The Service is provided "as is" without warranties of any kind.

12. Changes to these Terms

We may update these Terms from time to time. Continued use of Wishmori after changes take effect constitutes acceptance of the updated Terms.

13. Governing law

These Terms are governed by the laws of [Your jurisdiction - e.g. State/Country of incorporation], without regard to conflict-of-law principles.
